Who we are
PlantHarvester (plantharvester.com) is run by General Applications LLC, a Georgia limited liability company ("we", "us"). These Terms of Use cover your use of PlantHarvester: the Plant Library and the Market. By creating an account or using the site you agree to them. Farms that sell on the Market also agree to the Seller Terms. How we handle personal information is in the Privacy Policy.
Your account
- You must be at least 18 to create an account.
- Give accurate information, keep your password to yourself, and tell us at [email protected] if you think someone else is using your account.
- One person per account. You are responsible for what happens under your account.
- We may suspend or close an account that breaks these terms, puts other people at risk, or is used for fraud.
The Plant Library
The Library is general information about plants for gardeners and growers. It is not medical, nutritional, veterinary or professional agricultural advice. Hazard notes are there to help, not a complete list of every risk: never eat or give anyone a plant you cannot identify with certainty, and check with a qualified professional before relying on the Library for anything that matters to health or safety.
What the Market is
The Market connects buyers with independent local farms. Each farm is the seller of what it lists: it grows, describes, prices and hands over its own goods, and it is responsible for them. We run the website, take payment on the farm's behalf through our payment processor, Stripe, and keep a fee from the farm. We do not grow, inspect, store, transport or deliver anything sold on the Market: where a farm offers delivery, the farm itself brings your order.
Buying
- Prices, quantities and descriptions are set by the farm.
- You pay at checkout through Stripe. The charge on your statement shows the farm's name.
- An order is held for 30 minutes while you pay. If payment does not finish, the order is cancelled and you are not charged.
- At checkout you choose a pickup time, one of the times the farm keeps at its pickup location, and you collect your order in person then.
- Where a farm offers delivery you may choose it instead: you give the address, choose one of the farm's delivery times, and pay the farm's delivery fee with your order. The farm delivers only within the distance it states and for orders of at least the amount it states. The order is yours once it is handed over or left at the address you gave: be there to receive it, or say in the order's note where to leave it.
- If the farm will be away at the time you chose, it tells you, and moves your order to another of its times or refunds it. If the new time does not suit you, ask for a refund.
- If you do not pick up within 3 days of the pickup time you chose, the farm may cancel the order and refund you.
- Produce is a perishable, natural product grown outdoors. Look it over when you receive it, and wash and handle it as you would any fresh produce.
- Refunds follow the Refund Policy.
Messages and reports
Order messages are for arranging your order: be courteous, and do not use them to harass anyone, advertise, or share anything unlawful. We may read messages and other content when investigating a report or misuse. If a farm or listing looks unsafe, misleading or fraudulent, use "Report this farm" on its page.
Acceptable use
Do not use PlantHarvester to break the law, defraud anyone, or sell anything the Seller Terms prohibit. Do not interfere with the site, try to get into accounts or systems that are not yours, or copy the Library or listings at scale by scraping, crawling or other automated means for any purpose other than a search engine indexing public pages.
Content and ownership
The Library's text, data, illustrations and design belong to General Applications LLC. You may read and share it for your own non-commercial use, with a link back. What you post (a farm's name, descriptions, listings and messages) stays yours; you let us host, display and use it to run PlantHarvester, and you confirm you have the right to post it.
Disclaimers
PlantHarvester is provided "as is" and "as available". To the extent the law allows, we make no promise that the site will be uninterrupted or error-free, and no warranty about any farm or anything a farm sells. Your agreement about what you buy is with the farm that sells it.
Limit on our liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim about PlantHarvester is limited to the greater of what you paid through the Market in the 12 months before the claim, or $100. Some places do not allow these limits, so they may not all apply to you.
Indemnity
If you use PlantHarvester in a way that breaks these terms or the law, and someone brings a claim against us because of it, you agree to cover our reasonable costs of that claim, to the extent the law allows.
Disputes
Tell us about a problem first at [email protected]; most things can be put right quickly, and we will try for 30 days before either of us goes further. These terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules, and any dispute will be heard in the state or federal courts located in Georgia. Nothing here stops you using your local small-claims court where it applies.
Changes
We may update these terms. The date and version at the top change when we do, and for a significant change we will tell you by email or on the site, and may ask you to accept it before you continue.
